Historical Background of Consumer Disputes Redressal Commissions in the State of Punjab

Jurisdiction

The State Consumer Disputes Redressal Commission, Punjab (PSCDRC) exercises jurisdiction under the provisions of the Consumer Protection Act, 2019 as follows:

Original Jurisdiction
In terms of Section 47(1)(a)(i) of the Consumer Protection Act, 2019, the State Commission entertains consumer complaints where the value of the goods or services paid as consideration exceeds ₹50 lakh but does not exceed ₹2 crore.

Appellate Jurisdiction
Under Section 41 of the Consumer Protection Act, 2019, the State Commission hears appeals against the orders passed by the District Consumer Disputes Redressal Commissions. An appeal may be preferred on questions of fact or law within 45 days from the date of the order, subject to the provisions of the Act.

Revisional Jurisdiction
In accordance with Section 47(1)(b) of the Consumer Protection Act, 2019, the State Commission exercises revisional jurisdiction to call for the records and pass appropriate orders in consumer disputes where the District Commission has exercised a jurisdiction not vested in it by law, failed to exercise jurisdiction so vested, or acted in the exercise of its jurisdiction illegally or with material irregularity.

Transfer Jurisdiction
The State Commission is empowered to entertain applications for the transfer of consumer complaints from one District Consumer Disputes Redressal Commission to another within the State, in accordance with the provisions of the Consumer Protection Act, 2019.
